TERMS AND CONDITIONS FOR THE RESERVATION OF SERVICES WITH AKAMPA, S.A. DE C.V.

Thank you for booking with AKAMPA, S.A. DE C.V. (hereinafter "AKAMPA")! 

 

By clicking on the "book" button or booking by any of the means provided, and making an advance payment for any amount and/or for any concept related to the services provided in favor of AKAMPA, as a Client (hereinafter "THE CLIENT"), you or the persons you represent are subject to and accept the present terms and conditions, including the cancellation policy, the privacy policy and the data treatment that AKAMPA makes through the akampa.mx page. 

 

NATURE OF SERVICES   

By using AKAMPA's website or any of the means of communication that AKAMPA makes available to the CLIENT, the CLIENT acknowledges and accepts that the services provided by AKAMPA are, but are not exclusively limited to being shaped by the offer, organization, and provision of ecotourism services and recreational activities provided through third parties with whom AKAMPA has a commercial relationship for the purpose of providing the service.  

 

AKAMPA MISSION 

 

AKAMPA aims to facilitate the CLIENT'S connection with nature through the provision of ecotourism activities through third parties assisting in the publication and promotion of expeditions specifically designed in such a way that these expeditions comprise a trip designed in its majority or totality. These expeditions are conducted in compliance with applicable local and federal legal regulations.  

 

CUSTOMER GUARANTEES 

 

As a condition for requesting the reservation of an expedition, THE CLIENT guarantees that: 

 

  • You are at least 18 years of age and, in case of traveling with minors, that you have full guardianship over them, being their legal representative in case of incurring in any kind of civil liability, in full solidarity for any damage caused in accordance with the Federal Civil Code. 

 

  • Possesses the legal authority to create a binding legal obligation. 

 

  • It shall carry out the reservation process in accordance with this Agreement. 

 

  • Will only use established communication channels to make legitimate reservations for you or another person for whom you have legal authority to represent. 

 

  • All information provided through your person is true, accurate, current and complete. 

 

  • You have informed or will inform the persons traveling with you of the contents of these terms, including the implications of the risks involved in carrying out the activities you intend to do. 

  • The insurance information you have provided about your coverage is true, accurate, complete and up to date. 

 

By booking an expedition, you agree to pay at that time and make one payment and eventually all charges to complete the entire reservation, including the expedition price, applicable fees, off-line fees, taxes and other items identified during the payment process that are part of the total price of the expedition advertised and offered.  

 

Upon receiving confirmation of the expedition, the CLIENT enters into a contract to receive the services offered. The reservation is a limited license to enter, occupy and use the lodging provided by third parties through AKAMPA, as well as the amenities and products that it provides to perform the activities part of the expedition, and at no time affect the exclusive property that third parties or AKAMPA have over them. 

 

AKAMPA has all the rights to demand that the client be removed from the property or land owned in the terms provided by the applicable legislation, including with the assistance of public force, in the event that THE CLIENT prolongs its agreed stay. The CLIENT agrees to hold AKAMPA or any of its members harmless for any claim that may arise from the negligence or recklessness of the CLIENT. 

 

The CUSTOMER may not arrive with additional persons to those who booked the expedition, in which case AKAMPA has the right to refuse the expedition service to the CUSTOMER who brings with him/her third parties not included in the reservation made without the right to any reimbursement. 

 

RESPONSIBILITY 

 

AKAMPA is not responsible for any risk or damage suffered by the CUSTOMER when receiving the expedition services. The CLIENT is responsible for complying with all indications and undertakes to act carefully and diligently to avoid any damage when receiving the expedition and shall be liable for any damage caused by willful misconduct and negligence. 

 

CUSTOMER acknowledges and agrees that many activities involve inherent risks and agrees that, to the extent permitted by applicable law, CUSTOMER assumes all risk arising from its access to visits with AKAMPA, including its participation in any expeditions and any other interactions it has with other members, whether in person or online. This means that THE CLIENT is responsible for verifying an expedition to determine if it is suitable for THE CLIENT. For example, the services provided by their nature may involve risk of illness, bodily injury, disability or death, and THE CUSTOMER freely and voluntarily assumes those risks by choosing to participate in the expeditions he/she books. 

 

The CLIENT is aware that the activities that may be carried out as part of the services provided by AKAMPA are subject to contingent and uncontrolled situations derived from nature itself and its weather conditions, reason why AKAMPA will not incur in any kind of liability in the event that, AKAMPA will not incur in any kind of responsibility in the event that, due to a situation beyond its control, including but not limited to any case in which it is not possible to see and/or enjoy the flora, fauna, minerals, relief, water bodies, among others, the activity cannot be provided in its entirety in the way it was announced. The above, in the understanding that AKAMPA will do everything possible within its power so that such activity can be carried out in the terms that were announced within the applicable framework of the legislation. 

 

AKAMPA has full discretion to determine that the activities will not be carried out temporarily or totally due to a possible weather contingency that prevents its realization. In that case, a way will be sought to carry out the activities to the extent possible or that such activity is replaced by one that allows to be carried out at that time, without any obligation that the amounts that were disbursed by the CUSTOMER in favor of AKAMPA be reimbursed. 

 

THE CLIENT is responsible for confirming that he/she and anyone under his/her supervision meet the minimum age, competence, physical condition or other requirements established to carry out the activities. THE CLIENT is responsible for informing AKAMPA of any medical, physical condition or other circumstance that may affect his/her ability to participate, attend or take part in the expedition offered.  

 

PAYMENT, CANCELLATION AND REFUND POLICY 

 

By making a reservation in advance, the CLIENT agrees to have the capacity to legally bind and make full payment of the expedition so that it is reserved and confirmed. The CLIENT understands and accepts that the rates and prices offered may be subject to changes determined by AKAMPA unilaterally.

AKAMPA collects directly through the method of payment selected by the CUSTOMER the amounts corresponding to the total price of the expedition offered and receives the funds by way of advance payment in the account designated for that purpose, to organize the expedition. The above, in the understanding that AKAMPA carries out payments with third parties for its realization with certain contingent and independent anticipation of each trip and that may change for each CLIENT, which implies that THE CLIENT will not have the right to reimbursement of the totality of its payment at any time it demands it. As long as the totality of the agreed consideration is not covered, the amount disbursed will be considered as an advance payment, which must be complemented up to the totality of the price of the agreed consideration at least 60 working days prior to the date of the expedition, under penalty of the expedition being cancelled without the right to any refund in favor of THE CUSTOMER.

THE CLIENT shall not be entitled to a refund for the cancellation of the expedition at any time, regardless of whether he/she cancels more or less than 60 days in advance. However, THE CLIENT will have the right to transfer the amount paid to a third party who wants to go on the expedition or use it as an advance payment for another Akampa expedition, as long as the cancellation is made more than 60 days in advance. Said credit will be valid for 6 months from the date of the trip. In the event that the CLIENT cancels within 60 days prior to the expedition, the amount paid will not be transferable or refundable under any circumstances.

In the understanding that for the preparation of the expedition AKAMPA must make various arrangements with third parties, including, but not limited to, payments for the equipment, tour guides, transportation and food preparation, THE CLIENT shall not be entitled to any refund if due to force majeure he/she cannot attend the expedition, without any liability for AKAMPA, which shall comply with the provisions of the corresponding authorities.

When due to force majeure THE CLIENT is unable to attend the expedition, THE CLIENT shall have the right to transfer the reservation of the expedition to a third party up to 24 hours before the expedition takes place. Said third party, under its strict responsibility, is not insured under its sole responsibility.

By including expeditions that require a minimum quota, AKAMPA has the right to cancel the expedition in case this minimum quota is not met, which implies that the CLIENT will have the right to receive a full refund, which will be made within a period not exceeding 30 calendar days.

THE CUSTOMER will receive the corresponding reimbursement by the selected payment methods or any other that could be provided to facilitate the same.

 

FINANCIAL INFORMATION, INSURANCE AND COLLECTION AUTHORIZATION 

 

THE CLIENT acknowledges and accepts that he/she must provide personal and financial information for the reservation of expeditions, which will be treated in accordance with the privacy policy of akampa.mx. 

 

The CLIENT accepts and acknowledges that it is solely and exclusively his/her responsibility to provide the correct and complete data with which the expedition registration is made, so AKAMPA shall not be liable to the CLIENT or third parties that may be affected by giving incorrect information to the detriment of the CLIENT. In case the reservation for the expedition is made in less than 20 days, AKAMPA will not be able to guarantee the insurance coverage in place. 

 

THE CUSTOMER authorizes AKAMPA, using the information provided, to make the corresponding charges for the reservation and confirmation of the shipment in local currency to the payment methods provided by THE CUSTOMER and is not responsible for any loss derived from having provided incorrect information on the payment methods.  

 

AKAMPA reserves the right to make effective charges with the payment methods provided by the CUSTOMER for damages caused by the CUSTOMER in the property or equipment of the third party service provider during the reception of services provided duly justified with evidence from the third party. In that understanding, THE CUSTOMER will receive a notice of the situation and will have 72 hours to dispute with due evidence its exclusion of the claimed liability or its acceptance and payment thereof, in the understanding that, if it does not do so, THE CUSTOMER grants AKAMPA the right to collect the claimed damages so that they are deposited in AKAMPA's account, reserving the right to proceed by exercising the corresponding legal actions. 

 

IMAGE USAGE 

 

THE CLIENT, by making a reservation, accepts and grants AKAMPA an unlimited license to make use of any image or video taken and uploaded to AKAMPA's platform or social networks under the terms provided for in this agreement and the privacy policy of the website akampa.mx.
